An ‘Enhanced Service’ of refined data formatted to the CON29 questions and answers is available to members of the public (including personal search agents) through the Local Land Charges team in accordance with the Local Authorities (England)(Charges for Property Searches) Regulations 2008 and the “Personal Search Guidance Note” published by this council.  Should you choose to use this facility, then our published process (including charges) will apply.

The Environmental Information Regulations 2004 (EIR) allow for inspection of environmental information held by public bodies, including councils.  CON29 are considered to be covered by the EIR and should be made available at no charge for the purposes of compiling personal searches.  A personal search is simply a copy of all the registrations that are held on the local land charges register when a search is conducted against the address provided. The response we provide under EIR is a copy of the raw data only - it is unchecked, unverified and unofficial. As a result, it is for the customer to decide what information provided is relevant to that property or not.  To obtain information under EIR rules, a request should be made to the Freedom of Information Officer (foi@surreyheath/gov.uk (link sends e-mail)), only information not already available in the public domain will be provided.  

Please note that under EIR, the council has up to 20 working days to respond. If you do not wish the information to be sent to you, you may view the information on the Council premises. You will be offered a date and time to view the information, within 20 working days of receipt of your request.

In the interest of clarity, please include in full, the questions you wish to obtain information on. Please do not just refer to the CON29 question numbers.

A list of sources of information and data has been produced for the information covered by the CON29 2016 July version. Customers (including personal search agents) obtaining information through EIR should in each case also confirm with individual data-owning departments whether the provisions of the Re-use of Public Sector Information Regulations 2005 apply.
